Welcome to 4kay Events Pros (“Company,” “we,” “our,” or “us”), a marketplace platform connecting customers (“Clients”) with independent event and party rental service providers (“Vendors”). By accessing or using our website and services (the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use the Platform.
1. NATURE OF SERVICES
4kay Events Pros operates solely as an online marketplace that facilitates connections and transactions between Clients and Vendors.
We do not own, operate, or control any Vendor services listed on the Platform.
Vendors are independent contractors and are solely responsible for their services, pricing, policies, and performance.
Any agreement for services is between the Client and the Vendor, subject to the Vendor’s own terms displayed at the time of booking.
2. USER ACCOUNTS
To use certain features, you may be required to create an account. You agree to:
Provide accurate and complete information
Maintain the confidentiality of your login credentials
Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts at our sole discretion.
3. BOOKINGS AND PAYMENTS
All bookings are made through the Platform and processed securely via third-party payment processors (e.g., Stripe).
Full or partial payment may be required at the time of booking.
By making a booking, you authorize us to charge your selected payment method.
4. PAYMENT PROTECTION GUARANTEE
4kay Events Pros guarantees the safety of customer payments made through the Platform:
If a Vendor fails to fulfill a confirmed booking, the Client will receive a full refund of the booking amount (excluding non-refundable processing fees where applicable).
Refund eligibility is determined based on verification of non-fulfillment.
5. REFUND POLICY
5.1 Vendor Non-Performance
If a Vendor does not fulfill the agreed service:
The Client is entitled to a full refund of the booking amount.
5.2 Customer Cancellation
If a Client cancels a booking:
Refund eligibility is subject to the Vendor’s cancellation policy listed on the booking page.
Payment processing fees are non-refundable due to third-party processor policies.
In certain cases, 4kay Events Pros may issue credits or points to the Client’s wallet for future bookings at its discretion.
5.3 Vendor Cancellation
If a Vendor cancels:
The Client will receive a full refund or the option to rebook with another Vendor.
6. VENDOR TERMS
Each Vendor may establish their own service agreements, including:
Cancellation policies
Delivery terms
Setup and breakdown conditions
Damage deposits
These terms will be clearly displayed on the booking page and are binding upon acceptance by the Client.
7. LIABILITY DISCLAIMER
To the fullest extent permitted by law:
4kay Events Pros is not liable for any damages, losses, injuries, or disputes arising from services provided by Vendors.
We do not guarantee the quality, safety, legality, or suitability of Vendor services.
Clients agree to resolve disputes directly with Vendors when appropriate.
Under no circumstances shall 4kay Events Pros be liable for:
Indirect, incidental, or consequential damages
Loss of profits, revenue, or business opportunities
8. LIMITATION OF LIABILITY
Our total liability for any claim arising out of or relating to the Platform shall not exceed the total amount paid by the Client for the specific booking in dispute.
9. USER CONDUCT
You agree not to:
Use the Platform for unlawful purposes
Misrepresent information
Interfere with Platform operations
Circumvent payment systems
Violations may result in account suspension or legal action.
10. PRIVACY POLICY
4kay Events Pros respects your privacy and is committed to protecting your personal data.
10.1 Information We Collect
Personal information (name, email, phone number)
Payment details (processed securely via third-party providers)
Usage data and cookies
10.2 How We Use Information
To facilitate bookings and transactions
To improve Platform functionality
To communicate updates and promotions
10.3 Data Sharing
We may share information with:
Vendors to fulfill bookings
Payment processors
Legal authorities when required
We do not sell personal data to third parties.
10.4 Data Security
We implement reasonable security measures to protect your data but cannot guarantee absolute security.
11. INTELLECTUAL PROPERTY
All content on the Platform, including logos, text, and design, is the property of 4kay Events Pros and may not be used without permission.
12. TERMINATION
We reserve the right to terminate or suspend access to the Platform at any time, without notice, for violations of these Terms.
13. DISPUTE RESOLUTION
Any disputes arising from these Terms shall be governed by the laws of the State of Tennessee.
Parties agree to attempt informal resolution before pursuing legal action.
If unresolved, disputes shall be handled in the appropriate courts within Tennessee.
14. MODIFICATIONS
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
